By accessing or using SHOUT! ("the Game"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Game. These Terms apply to all users of the Game, including players who are also contributors of content, information, and other materials or services.

2. Web3 and Blockchain Integration

SHOUT! integrates blockchain technology and Web3 features. By using the Game, you acknowledge and agree that:

• You are responsible for maintaining the security of your cryptocurrency wallet and private keys
• All blockchain transactions are irreversible and we cannot recover lost assets
• Gas fees and network costs are your responsibility
• Smart contract interactions carry inherent risks

3. Digital Assets and NFTs

The Game may feature digital assets including but not limited to:

• Non-Fungible Tokens (NFTs) representing in-game items, characters, or achievements
• Fungible tokens for in-game currency or rewards
• Digital collectibles and unique assets

Ownership of NFTs grants you a limited license to use the associated digital content within the Game. This license is non-exclusive, non-transferable (except through approved blockchain transactions), and revocable under certain circumstances outlined in these Terms.

4. User Conduct and Prohibited Activities

You agree not to:

• Use bots, scripts, or automated methods to interact with the Game
• Exploit bugs, glitches, or vulnerabilities in the Game or smart contracts
• Engage in market manipulation or wash trading of Game assets
• Impersonate others or create fake accounts
• Violate any applicable laws or regulations
• Attempt to hack, reverse engineer, or compromise Game security

5. Intellectual Property Rights

All content in the Game, including but not limited to graphics, music, text, and code, is the property of SHOUT! or its licensors. NFT ownership does not grant you intellectual property rights to the underlying content beyond the specific usage rights outlined in these Terms.

6. Risk Disclosure

You acknowledge and assume the following risks:

• Cryptocurrency and NFT values are highly volatile
• Smart contracts may contain bugs or vulnerabilities
• Regulatory changes may affect the Game or your assets
• Technical issues may result in loss of access or assets
• The Game may be discontinued or modified at any time

7. Privacy and Data Collection

Your use of the Game is also governed by our Privacy Policy, which describes how we collect, use, and protect your information, including blockchain wallet addresses and transaction data.

8. AI-Generated Content Disclaimer

SHOUT! utilizes artificial intelligence technology to generate content including but not limited to:

• Character visuals, voices, and personalities
• Dialogue and conversational responses
• Music and audio content
• Game scenarios and interactions

AI-generated content may be unpredictable, inaccurate, or potentially inappropriate. We do not guarantee the accuracy, reliability, or appropriateness of any AI-generated content. You acknowledge that:

• AI responses are generated algorithmically and do not reflect our views or opinions
• You use AI-generated content at your own risk
• We are not liable for any harm or offense caused by AI-generated content
• AI-generated content should not be relied upon for factual information or advice

9. Health and Safety Warnings

Audio Warning: While we recommend using headphones for an optimal experience, prolonged use of headphones at high volumes may cause permanent hearing damage. We are not responsible for any hearing loss, tinnitus, or other auditory damage resulting from headphone use. Please:

• Keep volume at safe levels (below 85 decibels)
• Take regular breaks every hour
• Stop use immediately if you experience discomfort, pain, or ringing in your ears
• Consult a medical professional if you experience any hearing problems

You agree to indemnify and hold harmless SHOUT!, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Game or violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the Cayman Islands. Any disputes arising from these Terms or your use of the Game shall be resolved through binding arbitration in accordance with the rules of the Cayman Islands Arbitration Centre.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Game after changes constitutes acceptance of the modified Terms.
